YOUR AGREEMENT WITH RICHIE’S AUTO RENTAL
Richie’s Auto Rental as identified on page 1 hereby rents to the customer(s) undersigned on page 1, (herein called ‘Customer’) the motor vehicle (which, wherever used hereafter, includes all tires, tools, accessories and equipment), described on page 1 (herein called vehicle) subject to all the terms and conditions of page 1 of this Rental Agreement in consideration whereof Customer acknowledges and agrees:
- Vehicle is the property of Richie’s Auto Rental and is in good operating condition. Customer will return vehicle in the same condition and running order as when received, ordinary wear and tear excepted, to the place and the date specified on the Page 1 or sooner of demanded by Richie’s.
- Vehicle shall not be used: (a) to carry persons or property for hire; (b) to propel or tow any vehicle, trailer or other subject; (c) in any race, test or contest or abusive manner; (d) by any person except; (1) customer or (2) qualified licensed driver who’s license number must be on this agreement and driver us at least twenty-five years and over with minimum of 3 years driving experience. If vehicle is obtained from Richie’s Auto Rental by fraud of misrepresentation or is obtained or used in furtherance of an illegal purpose, all use of vehicle is without Richie’s Auto Rental’s permission.
- Customer will pay Richie’s Auto Rental on demand all time and mileage, service, minimum or other charges to be mentioned on page 1, at the rates shown or pursuant to the provisions hereof. In the event Richie’s Auto Rental makes any claim against customer, Customer will pay a reasonable attorney’s fee together with all expenses of collection or repossession and court costs.
- Subject to paragraphs 5 and 6 hereof, Customer is responsible for and will reimburse Richie’s Auto Rental promptly on demand for all loss of damage to vehicle. However, Customer’s liability for such loss or damage shall not exceed US$ 2,000.00 or XCD equivalent. Unless vehicle was used, operated or driven in violation of any provisions of this Rental Agreement in which event Customer will be liable or the entire loss or damage sustained by Richie’s Auto Rental the same promptly upon demand. Insurance charge US$5.00 daily or $13.50 EC.
- Customer shall be liable to Richie’s Auto Rental on account of non-collision losses to vehicle, including losses due to theft, and Customer shall pay all charges upon demand.
- In consideration of the Collision Damage Waiver rate agrees to relieve Customer of Liability for damages caused by collision. Collision Damage Waiver does not cover damage to interior or exterior of vehicle caused by negligence, and customer shall be fully liable for all damages of any nature if vehicle is operated in violation of any provision of the Rental Agreement.
- If Customer has directed the billing for charges to be transmitted to another person, firm or organization who fails to make payment promptly when due, Customer will promptly pay Richie’s Auto Rental said charges upon demand.
- Mileage shall be determined by reading odometer attached to the vehicle by the manufacturer.
- Customer releases and holds Richie’s Auto Rental, its agents and employees harmless from all claims for loss or damage to personal property of Customer or any other person, left or carried in or upon vehicle or any service vehicle or premises of Richie’s Auto Rental by Customer or such other person received, handled or stored by Richie’s Auto Rental at any time before, during or after this rental, whether or not same is due to Richie’s Auto Rental negligence or fault.
- In no event shall Customer or driver of vehicle be or be deemed the agent, servant or employee of Richie’s Auto Rental in any manner or for any purpose whatsoever.
- Customer will report all vehicle violations and will pay promptly all fines, penalties and forfeitures imposed for parking or traffic violations while vehicle is held, used, operated or driven to this Rental Agreement and will hold Richie’s Auto Rental harmless and indemnify Richie’s Auto Rental against all such claims arising out of such violations.
- No right of under this Rental Agreement may be waived except in writing by an authorized officer of Richie’s Auto Rental.
- Customer will be responsible for all punctures and shall pay for the repairs promptly.
- In case of an accident, please report the matter immediately to the nearest police station and Richie’s Auto Rental. No repairs should be done without the permission of Richie’s Auto Rental.
